These Terms and Conditions constitute an agreement between Ascend Commerce Co., Ltd. (hereinafter referred to as “the Company”) and you, as the “User,” regarding the provision of sales or additional consultation services related to the Company’s products or services on the website “https://weomni.com” (hereinafter referred to as “the Website”) under the terms set by the Company. The services provided by the Company will henceforth be referred to as “the Services”. Users are encouraged to thoroughly review these Terms and Conditions, along with any policies and agreements communicated by the Company or appearing on the Website (collectively referred to as “Terms of Service”) before submitting any information for consultation or registration for services on this Website. By doing so, Users agree to comply with and be bound by the Terms of Service, including those specified by the Company as follows:

2. Rights, Duties, and Responsibilities of Users

2.1 When registering for services on the Website and requesting consultations, Users must provide accurate, truthful, current, and complete personal information as specified by the Company.

2.2 Users agree to update and maintain the accuracy and completeness of the personal information provided in section 2.1 at all times.

2.3 Users agree to keep their login name and password confidential. If Users allow or authorize others to use their login name and password, or if transactions are made on the Website using their login name and password, such actions will be considered as performed by the Users themselves and will be legally binding. 2.4 In the event that Users engage in fraudulent, inappropriate, or unlawful activities that may harm other Users and/or the Company, Users agree to assume full responsibility for any resulting damages.

6.1 Collection
The Users agree and consent that the Company may access, collect, and use personal data of the User, as recorded and stored on the multi-purpose identity card (Smart Card), passport, or any other documents issued by government agencies, and/or data collected from other sources or individuals legally applicable at that time. This includes the collection and use of other personal data of the User as follows: name, surname, national ID number or passport number, date of birth, address, telephone number, purchase records of any goods or services, as well as information from User inquiries or interactions with the Company, such as comments, feedback, and questions.6.2

6.2 Purpose of Data Collection
Users agree to the collection, use, and disclosure of personal data for the following purposes:

• 6.2.1 To perform the obligations under the agreement between Users and the Company and to act upon the Users’ requests prior to entering into the agreement, to comply with the agreement between the Company and other parties beneficial to the Users, to process data for improving the efficiency of goods and services, for organizing or marketing products, services, and benefits, for promotional activities, for research, analysis, and market surveys, for compiling statistical data, and for presenting new products or services to Users in general.
• 6.2.2 To process data for enhancing the efficiency of goods and services, for organizing or marketing products, services, and benefits, for promotional activities, for research, analysis, and market surveys, for compiling statistical data, and for presenting new products or services to individual Users. For the purposes specified in Clause 6.2.2, the Company will seek the Users’ consent prior to using or disclosing such data. The Company will use this information in alignment with its objectives and to maximize benefits to the Users, in accordance with the Company’s policies and relevant laws.

6.3 Disclosure of Personal Data

• The Company may disclose or transfer personal data to companies within the business group of CP ALL Public Company Limited, companies within the business group of Charoen Pokphand Foods Public Company Limited, companies within the business group of True Corporation Public Company Limited, and companies within the business group of Ascend Group Limited, in order to carry out the purposes of service provision. The Company will seek the Users’ consent before any disclosure. Additionally, the Company may disclose personal data to third parties to comply with the terms of service, to auditors, external reviewers for accuracy and transparency in management, and to government agencies as required by law.

6.4 Duration of Data Retention and Use

• The Users agree and consent to the Company using the personal data of the User for the duration of their status as a service User. The Company will destroy or render such personal data no longer identifiable within 90 days from the date the User status ends, unless the data cannot be destroyed or deleted due to the Company’s necessity to retain it under contracts involving other parties or as required by law.

6.5 Rights of Personal Data Owners

• The User has the right to request access to and obtain copies of personal data that the Company has collected, used, or disclosed. If the Company has obtained personal data without the Users’ consent, the User may request the Company to disclose the method of acquisition. In cases where the Company collects personal data from other sources, such as social media channels or websites, the User has the right to request deletion or destruction of data, suspension, or anonymization of data in cases where the User cancels their status as a service User or where the Company has used personal data contrary to the stated purposes. The Users have the right to request correction of their personal data to be accurate, current, and complete. The Users have the right to object to the processing of personal data, the right to request the transfer of their personal data to another data controller, and the right to withdraw consent for purposes to which the Users have previously consented. Exercising these rights is subject to the conditions specified by law.

6.6 Impact of Withholding Personal Data

• The User acknowledges that failure to provide personal data may result in the inability to access certain parts of the website or to receive certain benefits from the Company, but the Users may still access other services on the website as usual. 7. Governing Law
These Terms of Service and any other agreements are governed by Thai law, without conflict of law principles, and Thai courts have exclusive jurisdiction.

These Terms are provided in Thai and serve as the governing document. Translations are for convenience only. In the case of inconsistencies, the Thai version prevails.

9. Prohibited Use
Users warrant that they will not use the Services for illegal purposes or violate the rights of others. The Company reserves the right to suspend or terminate Services and seek compensation for damages resulting from User actions.

11. Severability
If any provision of these Terms is found to be unlawful or unenforceable, such provision will be severed, and the remaining provisions will remain in effect.
